A judge has referred a Miami University student to a grand jury following an aggravated burglary incident Oct. 4.

A Miami University student is facing felony charges after Oxford Police responded to an aggravated burglary on Oct. 4.

According to a police report, police responded to a call for a burglary in progress just after 3 a.m. on Oct. 4. When police arrived, they found the suspect, Miami University student Ryan McQuain, being restrained by the victim, a 79-year-old emeritus professor at Miami University. McQuain and the victim are neighbors, according to F0x 19.

The incident report states that the victim heard McQuain on the front porch, making loud noises and pacing up and down the porch. When the victim opened the door to make contact with him, a struggle ensued, and McQuain struck the victim with a closed fist at least a dozen times in the sides of his head and upper body. According to court records, it was McQuain’s birthday.

McQuain is now facing two felony charges of aggravated burglary and an additional felony charge for drug possession. Police reported finding a small clear plastic bag containing “an unknown white powder inside of Ryan’s wallet,” according to the police report.

On Oct. 10, a judge referred McQuain’s case to a grand jury, where they will determine whether the state had good enough reason to felony charges against him.
